The Supreme Court Republicans make an Evil Genius ruling

Trump, you may remember, has claimed absolute immunity for anything he does as president, even order his political opponents killed. The Supreme Court’s opinion: maybe.

More precisely, the president has immunity for anything he does as an official act. What constitutes an official act? The courts decide, which means in a presidential case, SCOTUS ultimately decides. Which means they can handwave anything a Republican does without having to extend the same standard to Democrats. According to a quote from the decision at the link: “”Our consideration is limited to the present circumstances, for the problem of whether all presidents have immunity for any act that they assert is official presents many complexities.” That way they’re covered no matter who wins in November.

By sending the case (Trump’s role on J6) back to the lower courts they’ve also postponed a final decision on that until after the election. Less political ammo that way. However they’ve also told the lower courts that ”Testimony or private records of the President or his advisers probing such conduct may not be admitted as evidence at trial.” Which if things do against Trump in November will make prosecuting him that much harder.

Coupled with their recent decisions gutting administrative law, I think this may be the worst Supreme Court session in a very long time.
