To wit, an article on Jack Kirby’s heirs’ lawsuit against Marvel over the rights to Kirby’s countless creations. It’s two years old, but I think it’s the best, clearest explanation of the issues I’ve seen.
Contrary to what I’ve heard over the years, it seems the 1909 copyright laws (updated in ’76) did acknowledge the concept of work-for-hire, even if it wasn’t called that. In Kirby’s case, Marvel commissioned his work on FF, Hulk, etc., and paid him for it, which satisfies the “instance and expense test for work-for-hire. So Kirby’s heirs lost out.
